Achieving the American Dream

Becoming a citizen is a big step in anyone's life. In order to achieve this dream, there are a few steps that you must take. At the Saenz-Rodriguez law firm, our lawyers can advise and guide you through the naturalization process. They can also assist you in overcoming obstacles to your becoming a citizen. If you believe that you or someone you love may be eligible for American citizenship, contact Saenz-Rodriguez & Associates to speak with an experienced naturalization lawyer.

Are you eligible to become a citizen?

In order to become a US citizen, you must

n Be a permanent resident for five years, or three years if you are married to a United States citizen.

n Be a person of good moral character. There must be NO RECORD of criminal activity at all during the statutory period.

If you have a criminal record

Having your criminal record expunged is no longer sufficient to obtain citizenship. You must now obtain a full pardon from the president or your state governor. If you do not, your citizenship application could land you in removal proceedings for what now may be a deportable offense. Our law office handles cases that involve

  • 212(c) or "Saint Cyr" waivers
  • Cancellation of removal
  • Withholding of removal

If you have a criminal record -no matter how old- you could not only be taking a risk to become a United States Citizen, but you could also expose yourself to removal proceedings and the loss of your resident status. Do not attempt to file for citizenship on your own unless you have consulted with a lawyer. Even the most minor offense can trigger major trouble.

Derivative or Acquired Citizenship

This is a rare form of relief. When it applies, it can make the difference between deportation and being able to stay in the U.S. If you have a parent or grandparent that was born in the United States who has children here, or brought them over, you can sometimes acquire citizenship from that person.
