Definition of AsylumA person is eligible for asylum if, in their home country, they are subject to persecuted based on their "race, religion, political opinion, nationality, or membership in a social group." Asylum CasesThere are two types of asylum cases Affirmative Asylum. With this type, the immigrant requests asylum from the outset before he or she is in removal proceedings. Asylum in Removal. These cases happen one of two ways. Either the immigrant raises the subject while in removal, or his or her initial bid for asylum was denied, and must now be heard in front of an immigration judge. Our law office handles both types of cases. Asylum AlternativesIf a person is a convicted felon, they are usually subject to deportation. However, if we can prove that, if they go back, they will be subject to persecution, we can get the removal withheld. The standard of proof for withholding is very high, but it can sometimes make a difference between deportation and staying. Withholding of Removal. If you have been convicted of an aggravated felony after 1997, this is the only form of relief available. Cancellation of Removal. This may be available if your crime was not a serious one. Cancellation is based on the discretion of the court. They look at, among other factors, whether you are otherwise an upstanding member of your community, or how likely you are to be a repeat offender.
